Welcome to Tow & Go Trailer Rentals (“Tow & Go,” “we,” “us,” or “our”). These Terms & Conditions govern your use of our website and the reservation and rental of trailers and related equipment from Tow & Go Trailer Rentals in New Brunswick, Canada.

By making a reservation, submitting payment, accepting these Terms & Conditions during checkout, or entering into a rental agreement with us, you agree to be bound by these Terms & Conditions.

1. Rental Agreement

Every trailer rental is also subject to the Tow & Go Trailer Rentals Rental Agreement provided to the renter.

These Terms & Conditions apply generally to use of our website and booking services. The Rental Agreement contains additional terms specific to the rental, including the trailer rented, rental period, condition of the equipment, renter responsibilities, damage, security deposits and other applicable charges.

If there is a conflict between these Terms & Conditions and the Rental Agreement, the Rental Agreement will govern with respect to the specific rental, to the extent permitted by applicable law.

2. Eligibility to Rent

To rent a trailer from Tow & Go, the renter must:

  • have the legal capacity to enter into a binding contract;

  • hold a valid driver’s licence appropriate for operating the tow vehicle;

  • provide accurate identification and contact information when requested;

  • use a properly registered, insured and roadworthy tow vehicle; and

  • comply with any additional eligibility requirements disclosed at the time of booking or in the Rental Agreement.

Tow & Go reserves the right to refuse or cancel a rental where we reasonably believe that the renter, tow vehicle, intended use or towing arrangement presents a safety, legal or insurance concern.

3. Tow Vehicle and Trailer Compatibility

The renter is responsible for ensuring that the tow vehicle is suitable for the trailer being rented and has adequate towing capacity for the trailer and intended load.

The renter is responsible for confirming, as applicable:

  • the vehicle’s towing capacity;

  • hitch and ball compatibility;

  • electrical connections;

  • braking requirements;

  • payload and weight limits; and

  • any other equipment required for safe and lawful towing.

The renter must never exceed the trailer manufacturer’s weight ratings, payload limits or the towing limits of the tow vehicle.

If you are unsure whether your vehicle is suitable for a particular trailer, please contact Tow & Go before completing your rental.

4. Reservations and Payment

All reservations are subject to trailer availability and confirmation by Tow & Go.

Rental prices, rental periods, security deposits, optional equipment, fees and any applicable taxes will be disclosed during the booking process or in the Rental Agreement.

A reservation is not guaranteed until any required booking information and payment have been received and the reservation has been confirmed.

All prices displayed on our website are in Canadian dollars unless otherwise stated.

We reserve the right to correct genuine pricing, availability or technical errors. If an error affects an existing reservation, we will contact the renter before proceeding with any material change to that reservation.

5. Security Deposits

A refundable security deposit or payment-card authorization of $200.00 is required before the trailer is released.

After return, Tow & Go will inspect the trailer and accessories. The deposit may be applied toward unpaid rental charges, late fees, excessive cleaning, missing accessories, damage, towing, recovery, storage, loss of use, or other amounts properly owing under the rental agreement.

The Renter will receive an explanation of deductions made from the deposit. Any remaining balance will be released or refunded after the inspection is completed. Ordinary wear from proper use will not be charged against the security deposit.

Financial institutions may require additional processing time before released funds become available.

6. Cancellations, No Shows & Refunds

Cancellations must be made at least 24 hours prior to the scheduled rental start time to receive a full refund. Cancellations made with less than 24 hours notice will result in forfeiture of the security deposit.

A Renter who does not arrive within 2 hours of the scheduled pickup time and has not contacted Tow & Go may be treated as a no-show. No-shows are subject to cancellation of the reservation and forfeiture of the security deposit.

Tow & Go may cancel or reschedule a reservation because of unsafe conditions, mechanical concerns, delayed returns, severe weather, or circumstances outside its reasonable control. In that situation, Tow & Go’s responsibility will generally be limited to refunding amounts paid for the unavailable rental.

7. Pickup, Return & Inspection

Trailers must be picked up and returned at the agreed location and within the rental period shown on the reservation or Rental Agreement.

The renter must return the trailer:

  • on time;

  • in substantially the same condition in which it was received, subject to reasonable wear and tear;

  • reasonably clean;

  • with all rented accessories and equipment; and

  • free of personal property, garbage and prohibited materials.

Late returns may result in additional rental charges or fees as set out in the Rental Agreement.

If the renter expects to be late, Tow & Go should be contacted as soon as reasonably possible. An extension is not effective unless approved by Tow & Go.

The Renter must inspect the trailer and accessories before leaving the pickup location.

Any existing damage, missing equipment, or concerns must be reported before departure and recorded on the rental inspection form or in photographs. Unless otherwise documented, the trailer and accessories will be considered clean, complete, functional, and in acceptable condition when released.

By accepting the trailer, the Renter confirms that they have had an opportunity to inspect it and ask questions about its operation. The renter must not use a trailer that the renter reasonably believes is unsafe. Any safety concern that arises during the rental must be reported to Tow & Go as soon as possible.

8. Safe and Permitted Use

The renter agrees to use the trailer responsibly, safely and in accordance with all applicable laws, manufacturer requirements and instructions provided by Tow & Go.

The renter must not:

  • overload the trailer;

  • exceed applicable weight or towing limits;

  • permit an unauthorized or unqualified person to tow the trailer;

  • use the trailer for an unlawful purpose;

  • carry passengers in or on the trailer;

  • operate or tow the trailer in a reckless or unsafe manner;

  • modify, dismantle or tamper with the trailer or equipment;

  • sub-rent, lend or transfer possession of the trailer without permission from Tow & Go; or

  • use the trailer in a manner prohibited by the Rental Agreement.

Loads must be properly positioned, balanced and secured before the trailer is moved.

The renter is responsible for checking the trailer, hitch connection, safety chains, lights, tires, load securement and other relevant safety items during the rental as reasonably necessary.

9. Damage, Loss and Renter Responsibility

The renter is responsible for taking reasonable care of the trailer and rented equipment while it is in the renter’s possession or control.

Subject to applicable law and the Rental Agreement, the renter may be responsible for loss of or damage to the trailer or equipment resulting from misuse, negligence, collision, improper loading, overloading, theft, vandalism, failure to secure the trailer or equipment, or breach of the Rental Agreement.

The renter may also be responsible for reasonable costs associated with missing equipment, excessive cleaning, towing, recovery or repairs where those costs arise from the renter’s use or breach of the rental terms.

Ordinary wear and tear is not considered renter-caused damage.

Nothing in these Terms & Conditions limits any warranty, remedy or other right that cannot lawfully be excluded or limited.

10. Accidents, Damage and Breakdowns

The Renter is responsible for loss of or damage to the trailer and accessories occurring during the rental period to the extent caused by the Renter, an approved or unauthorized driver, the Renter’s cargo, misuse, negligence, breach of these Terms, theft, vandalism, collision, improper loading, or improper securement. If the trailer is involved in an accident, becomes damaged, is stolen or develops a mechanical or safety problem, the renter must:

  1. stop using the trailer where continued use may be unsafe;

  2. take reasonable steps to prevent further damage or injury;

  3. contact Tow & Go as soon as reasonably possible; and

  4. where appropriate, contact police, emergency services or other relevant authorities.

The renter must not authorize significant repairs or alterations to the trailer without Tow & Go’s approval unless immediate action is reasonably necessary to protect persons or property.

11. Tickets, Tolls and Legal Violations

The renter is responsible for fines, tickets, tolls, impound charges and similar costs arising from the renter’s possession or use of the trailer during the rental period, to the extent permitted by law.

The renter is also responsible for complying with applicable towing, highway, vehicle, load securement and traffic laws.

Tow & Go may charge the Renter for these amounts together with a reasonable administrative fee, where permitted by law.

12. Limitation of Liability

To the fullest extent permitted by law, Tow & Go will not be responsible for indirect, incidental, special, or consequential losses, including lost profits, missed appointments, accommodation expenses, replacement transportation, or loss of use of the Renter’s property.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limits any mandatory rights available to a consumer under applicable law.

13. Trailer Availability

Although we make reasonable efforts to ensure that reserved trailers are available, unforeseen mechanical, safety or operational issues may occasionally make a trailer unavailable.

Tow & Go may substitute an appropriate trailer where agreed with the renter or cancel the reservation if a safe and suitable trailer is unavailable.

Safety concerns take priority over completion of a rental.

14. Website Information and Images

We make reasonable efforts to keep the information on our website accurate and current. However, availability, specifications, pricing and other information may occasionally change or contain an error.

Photographs and illustrations on the website may be provided for informational purposes. Renters should rely on the specifications and information applicable to the particular trailer confirmed in their reservation or Rental Agreement.

15. Personal Information

Tow & Go may collect personal information reasonably required to process reservations, verify renter information, communicate with customers, process payments, administer rentals and meet legal or insurance requirements.

Our collection, use and protection of personal information is further described in our Privacy Policy.

Payments and online reservations may also be processed through third-party service providers, which may have their own terms and privacy practices.

16. Website Use

You may use the Tow & Go website for lawful personal or business purposes relating to our trailer rental services.

You must not attempt to interfere with the operation or security of the website, gain unauthorized access to our systems, submit fraudulent reservations or use the website for any unlawful purpose.

17. Changes to These Terms

Tow & Go may update these Terms & Conditions from time to time.

The version posted on our website at the time a reservation is made will generally apply to that reservation, together with the Rental Agreement entered into for that rental.

Changes to these Terms will not retroactively alter an existing completed rental agreement except where agreed by the parties or required by law.

18. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

19. Governing Law

These Terms & Conditions are governed by the laws of the Province of New Brunswick and the applicable laws of Canada.

Nothing in these Terms & Conditions is intended to limit any rights or remedies available to a consumer under applicable law.
